Terms of use.
Using this site means accepting what follows. Most of it is the same commitment the software already enforces, written out in the language a court would read. The parts that matter most are what an entry is not, and the one use of this record that is flatly forbidden.
Effective . Operated by StephensCode LLC, a Texas limited liability company.
Who operates this site
CardConduct is operated by StephensCode LLC, a Texas limited liability company. Correspondence, including legal notices, goes to legal@cardconduct.com. Copyright notices have their own route and their own required contents, described on the takedown page.
In these terms, "we" and "us" mean StephensCode LLC, and "you" means anyone reading the record, filing a report, or filing a dispute.
What this site is
CardConduct is an independent record of the public selling conduct of public trading-card seller handles, across all card games. Entries come from reports submitted by the public, and each one is published only after our own investigation records a factual basis for it. How that works, and the 3 to 5 days window it runs in, is set out on the policy page, and the parts of it that can be enforced in code are enforced in code rather than left to a moderator to remember.
Opinion, supported by disclosed evidence
An entry is a statement of caution and opinion, based on the evidence published alongside it. The screenshots, the observations, and the sources we checked are all shown so that you can evaluate them yourself and reach your own conclusion. Nothing here states that any person or business has committed a crime. Nothing here is a legal finding, a court judgment, or a determination of guilt.
Handles, not people
We identify a seller by their public handle or storefront and by public selling conduct only. We do not publish legal names, addresses, phone numbers, employers, or other private details, and reports containing them are rejected.
Accuracy and correction
We investigate before publishing and re-investigate on dispute. Reports still come from the public, and evidence can be incomplete or mistaken. If an entry is wrong, file a dispute. Entries that do not hold up are corrected or removed, and the audit log records the correction instead of erasing it.
This is not a consumer report
You may not use this record, in whole or in part, as a factor in any decision about a person's eligibility for:
- Employment, hiring, promotion, retention, or contracting.
- Credit, lending, or the terms of either.
- Insurance underwriting or pricing.
- Housing, tenancy, or a rental application.
- A government licence or benefit.
- Any other purpose covered by the Fair Credit Reporting Act.
This is not a formality. The record is not assembled to FCRA standards, it carries no FCRA dispute or reinvestigation procedure, and it names handles rather than identified people, so a handle here may not be the person you think it is. Using it that way is a breach of these terms and your own legal problem, not ours. This record exists to help a buyer decide who to buy a card from. That is its purpose and its only sanctioned use.
Acceptable use
You may
- Read, search, and link to any public entry.
- Quote an entry with attribution and a link, including in a report you file with a marketplace.
- Use what you find here to decide who you personally will and will not buy from.
You may not
- Use the record for any FCRA-covered decision, or resell or repackage it as a screening, background-check, or tenant-screening product.
- Use an entry to harass, threaten, or intimidate anyone, or to contact a seller's family, employer, or customers.
- Present an entry as a finding of guilt or a criminal accusation. It is neither, and saying it is puts the words in your mouth, not ours.
- Submit a report you know to be false, altered, retaliatory, or that exposes private information.
- Scrape or bulk-collect the record outside what robots.txt permits, or run automated submissions against the report or dispute forms.
- Attempt to reach the moderation console, another user's data, or any part of the system not published for the public.
We can block a source, refuse submissions, and withdraw a partner site's posting authorization at our discretion when any of this happens.
Submitting a report
By filing a report you confirm that:
- Your report is truthful and describes conduct you actually observed.
- The screenshots you attach are genuine and unaltered.
- You are reporting public selling conduct, not a private dispute or a grudge.
- You have not included anyone's legal name, address, or other private details.
- You have the right to give us the images you are attaching, and giving them to us does not break an agreement you are under.
You keep whatever rights you have in what you submit. You give StephensCode LLC a non-exclusive, worldwide, royalty-free licence to store your submission, re-encode the images, and publish them as part of an entry and its audit log. That licence exists so an entry can keep standing on its evidence; it covers nothing else and is not transferred or sold.
Reports that are fabricated, altered, retaliatory, or that expose private information are rejected, and the submitting source may be blocked. Because we never learn who you are, we cannot tie a submission back to you, and equally we cannot restore a report on your say-so without the details that let us find it.
Partner sites and no affiliation
Some reports arrive from partner communities that post into this same queue from their own sites. Those reports go through the identical investigation before anything publishes. A partner does not decide what is listed, does not moderate, and is not responsible for an entry, and linking to the record does not make them a publisher of it.
CardConduct is not affiliated with, endorsed by, or sponsored by any marketplace, card manufacturer, game publisher, grading company, or creator. All trademarks belong to their respective owners and are used here only to say where conduct happened.
Availability, warranties, and liability
No guarantee of availability
This is a free service run by a small operator. We can change, suspend, or discontinue any part of it, including individual entries and the site as a whole, at any time.
No warranty
The site and everything on it is provided as-is and as-available, with no warranty of any kind, express or implied, including any implied warranty of accuracy, merchantability, fitness for a particular purpose, or non-infringement. We work to keep the record accurate and we correct it when it is not, but we do not warrant that it is complete, current, or error-free. Decisions about who to buy from are yours.
Limitation of liability
To the maximum extent permitted by law, StephensCode LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost sales, lost data, or loss of goodwill, arising out of your use of this site or your reliance on anything published here, whether the claim is in contract, tort, or anything else, and even if we were told such damages were possible. To the same extent, our total aggregate liability for all claims relating to this site is limited to one hundred United States dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limits above apply only as far as that jurisdiction allows, and nothing here removes a right you have that cannot be waived.
Your responsibility for what you submit
If a claim is brought against us because of material you submitted, including a claim that it was false, altered, infringing, or exposed private information, you agree to indemnify StephensCode LLC for that claim and the reasonable costs of defending it.
Governing law and venue
StephensCode LLC, a Texas limited liability company, operates this site from Texas. These terms, and any dispute arising out of them or out of your use of this site, are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules.
Any action must be brought exclusively in the state and federal courts located in Montgomery County, Texas, and you consent to the personal jurisdiction of those courts. If you are outside the United States, you are choosing to use a site operated from Texas and this section applies to you as well.
Before filing anything, use the dispute form. It is free, it is read by the same person, and it is the fastest way to get an entry re-checked.
Changes to these terms
We can change these terms. When we do, the effective date at the top of this page changes with them, and the new version applies from that date to your continued use of the site. Material changes will be stated plainly on this page rather than folded in quietly. We do not publish an archive of earlier versions, so if a specific wording matters to you, keep a copy.
If any part of these terms is held unenforceable, the rest stays in force. Not enforcing a term on one occasion is not a waiver of it. These terms, together with the privacy policy, the takedown policy, and the list policy, are the whole agreement between us about this site.
